"Daniel Fogarty, on September 22, came to his death through accidental poisoning by foul gases in the Try It mine, Paddington, and they further say that there was negligence shown on the part of the miners working in the north end of the stope by not running the pass when they knew their mates were entombed. That there was also negligence shown on the part of the under-ground manager in allowing cyanide tailings to be tipped down No. 4 winze knowing it had a blind end and had men in it—but that such negligence does not amount to manslaughter."
